Mandatory Labeling for AI-Generated Content

This bill mandates clear disclosures for content (images, videos, audio, and text) substantially created or modified by generative artificial intelligence systems. AI systems must include a disclosure on such content that is, to the extent technically feasible, permanent or unable to be easily removed. Developers of AI systems must implement reasonable procedures to prevent downstream use without these required disclosures, with enforcement handled by the Federal Trade Commission (FTC).
Key points
AI-generated content, including chatbot text, must carry a clear and conspicuous disclosure identifying it as AI-created.
Output metadata must include identification as AI-generated content, the identity of the tool used, and the date and time created.
The Federal Trade Commission (FTC) will enforce non-compliance as an unfair or deceptive act or practice.
The Director of NIST will establish a working group to publish a framework and technical standards to assist platforms in identifying AI-generated content.
