Farewell to Foam: National Ban on Polystyrene Food Containers and Coolers by 2026

This legislation establishes a nationwide ban on the sale and distribution of most expanded polystyrene (Styrofoam) products, including single-use food service ware, packaging peanuts, and portable coolers. Starting January 1, 2026, restaurants, retailers, and manufacturers must switch to alternative materials, changing how takeout food and packages are handled. The goal is to reduce environmental pollution caused by this difficult-to-recycle material.
Key points
Starting January 1, 2026, the use of Styrofoam containers for takeout food and beverages will be prohibited for all food service providers and retailers.
The ban also covers the sale of Styrofoam packaging peanuts and portable coolers (excluding those used for drugs and medical products).
Violations will result in civil penalties imposed by the Environmental Protection Agency (EPA), starting with a written warning for the first offense.
