Closing Auto Tariffs Loopholes: Clarifying Origin of Vehicles from Adversary Nations
This Act aims to change how the country of origin is determined for passenger motor vehicles if they were produced or assembled by entities linked to designated foreign adversary nations. These vehicles will be treated as originating in the adversary country, potentially subjecting them to higher tariffs. For citizens, this could impact the availability and price of certain imported cars, potentially increasing purchase costs or limiting model choices.

Passenger vehicles (classified under heading 8703) produced or finally assembled by entities linked to foreign adversaries will be treated as originating in that adversary country.
The change takes effect 180 days after enactment and is intended to close loopholes in auto tariffs.
The list of foreign adversaries includes China, Russia, Iran, North Korea, Cuba, Venezuela (under Maduro), and Syria.
An entity is considered linked if a foreign adversary party holds at least 25% of its equity interests, directly or indirectly.
