Consumer Choice: Right to Refuse Electric Vehicle Rental Without Penalty.

This Act requires that rental car companies cannot force customers to rent an electric vehicle (EV) unless the customer explicitly chooses one. If only EVs are available upon pickup and the customer did not opt-in, they can terminate the agreement without incurring any fees or penalties. This protects consumer choice regarding vehicle type during the rental process.
Key points
Rental companies must obtain explicit customer consent ("opt-in") before providing an electric vehicle.
If a customer did not opt-in, and only EVs are available at pickup, the customer must be allowed to terminate the agreement fee-free.
Rental companies must notify customers no later than 12 hours in advance if they anticipate only having EVs available, provided the reservation was made earlier than 24 hours before pickup.
Violations can lead to civil lawsuits by harmed individuals seeking damages and legal costs.
