Protecting the Right to Vote: Prohibiting Undue Burdens in Federal Elections

This Act aims to strengthen the fundamental right of every citizen to vote in Federal elections. It prohibits government actions that unduly diminish or substantially impair the ability to vote, unless such actions are the least restrictive means of achieving an important governmental interest. Citizens gain the ability to quickly challenge in court any new rules that make voting more difficult, thereby protecting their electoral rights from unjustified changes.
Key points
Strengthening Voting Rights: Every citizen of legal voting age has the fundamental right to vote in Federal office elections.
Prohibition of Diminishment (Retrogression): Governments cannot adopt measures that diminish the ability to vote unless it is the least restrictive means to significantly further an important, particularized government interest.
Protection Against Substantial Impairment: Governments are prohibited from substantially impairing the ability to vote unless it significantly furthers an important governmental interest.
Expedited Judicial Review: Citizens can bring civil actions to challenge violations of these rights, and courts are required to expedite the disposition of these cases.
Effective Dates: Rules concerning diminishment (retrogression) apply to governmental actions not in effect during the November 2022 election but effective on or after September 1, 2024.
