Strengthening Gun Checks, Increasing Penalties, and Protecting Second Amendment Rights
This Act aims to enhance the National Instant Criminal Background Check System (NICS) by mandating federal agencies to prioritize sharing relevant records, especially mental health data. It clarifies the definition of mental incompetence, requiring a judicial finding of danger before a person loses their gun rights in cases arising from Veterans Affairs administration. Furthermore, the legislation facilitates the legal interstate transport of firearms and ammunition and increases penalties for illegal purchases, boosting public safety through intensified prosecution of gun violence.
Key points
NICS System Enhancement: Federal agencies must prioritize and regularly submit relevant records, including mental health adjudications, to NICS to close background check loopholes.
Protection for Veterans: In cases arising from Veterans Affairs administration, individuals deemed mentally incapacitated will not be considered mentally incompetent for firearm purposes without a judicial finding that they pose a danger.
Interstate Transport Facilitation: Lawful gun owners are entitled to transport unloaded and secured firearms and ammunition across state lines, protecting them from arrest for violating local laws provided the items are inaccessible or locked.
Increased Penalties: Maximum prison sentences for making false statements during a firearm purchase (lying and buying) are increased from 5 to 10 years.
Federal Prosecution Boost: Establishment of the Nationwide Project Exile Expansion program in jurisdictions with the highest homicide rates to increase federal investigation and prosecution of covered firearms offenses.
Firearm Commerce Modernization: Licensed dealers are permitted to sell firearms and ammunition at temporary locations in any state.
