Equal Remedies for Workplace Discrimination, Including Age Discrimination

This Act aims to equalize the remedies available for workplace discrimination. It amends statutes to allow for compensatory damages covering pecuniary losses, emotional pain, suffering, and loss of enjoyment of life in a broader range of cases. Additionally, it amends the Age Discrimination in Employment Act (ADEA) to provide any legal or equitable relief available under Title VII of the Civil Rights Act of 1964, and allows any party to demand a jury trial.
Key points
Expanded Definition of Losses: Compensatory damages are explicitly defined to include past and future pecuniary losses, emotional pain, suffering, inconvenience, mental anguish, and loss of enjoyment of life.
Equal Remedies for Age Discrimination: The ADEA is amended to provide the same powers, remedies, and procedures as set forth in Title VII of the Civil Rights Act of 1964.
Right to a Jury Trial: In specified discrimination cases, any party may demand a trial by jury.
