Campus Sexual Assault Support: Mandating Independent Advocates at Universities

This Act mandates that every institution of higher education receiving federal financial aid must designate an Independent Advocate for Campus Sexual Assault Prevention and Response. The Advocate must represent the victim's interests, even when they conflict with the institution's, ensuring confidential support, access to medical care, counseling, and assistance through administrative and legal processes. Students gain guaranteed access to independent and confidential help following a sexual assault on campus, without fear of retaliation from the institution.
Key points
Mandatory Independent Advocate: All federally funded colleges must appoint an Advocate to support sexual assault victims, operating independently from the bodies that investigate and adjudicate complaints.
Confidentiality and Non-Retaliation: The Advocate must maintain victim privacy and confidentiality, and victims cannot be disciplined or penalized for reporting the assault to the Advocate.
Comprehensive 24/7 Services: The Advocate ensures victims receive 24-hour access to emergency medical care, forensic exams, crisis counseling, legal information, and guidance through reporting and adjudication processes.
Victim-First Representation: The Advocate's role is to represent the interests of the student victim, even if those interests conflict with the institution's.
