Emerging Innovative Border Technologies Act: Implementation Plan and Impact Assessment

The Act requires the Secretary of Homeland Security to develop a plan to identify and deploy new, secure technologies to support U.S. Customs and Border Protection (CBP) mission needs along borders and at ports of entry. This plan, submitted to Congress, must include an assessment of the potential impact of these technologies on privacy, civil rights, and civil liberties, along with mitigation measures. The Act also provides for an analysis of legacy technology programs that could be phased out and replaced with new solutions.
Key points
Requirement to submit a plan for deploying innovative technologies (e.g., unmanned systems, surveillance technology, new inspection methods) within 180 days of enactment.
Mandate to assess the impact of new technologies on privacy, civil rights, and civil liberties, and to identify mitigation measures.
Authorization for the CBP Commissioner to maintain CBP Innovation Teams to research and adapt commercial technologies.
Before large-scale deployment of new technology, the Secretary must consider costs and benefits to ensure quantifiable improvements to border security.
