Ensuring Medicaid continuity for military families during relocation.

This Act ensures that military families temporarily relocated to another state due to service orders will not lose access to Medicaid or their place on waiting lists for specialized Home and Community-Based Services (HCBS). Effective January 1, 2028, these changes protect the continuity of health benefits for active duty members and their dependents during relocation. The original state remains responsible for covering medical assistance costs in the new, temporary state.
Key points
Military relocation is treated as a temporary absence, allowing families to maintain residency status in their original state for Medicaid purposes.
Individuals on Home and Community-Based Services (HCBS) waiting lists will keep their spot in the original state, even after moving to a new jurisdiction.
The provisions cover active duty members, recent retirees (up to one year post-relocation), and their dependents, ensuring continued access to benefits in the temporary state.
States must implement these new requirements starting January 1, 2028.
