Increased Data Control: Consent Required for Platform Data Collection and Sale.
This Act introduces strict new rules for large internet platforms (over 30 million users) regarding the collection and use of personal data (habits, preferences, location). Platforms must obtain your explicit consent before collecting your data or selling it to third parties. You gain the right to revoke consent and demand the deletion of all collected information at any time, giving you greater control over your online privacy.
Key points
Explicit Consent Requirement: Large internet platforms (e.g., social media, search engines) cannot collect your data (e.g., preferences, location) without your explicit consent.
No Data Sale Without Consent: Platforms are prohibited from selling or sharing your data with third parties without your separate, explicit consent.
Right to Data Deletion: You have the right to request the deletion of all data collected about you and to withdraw consent for further collection at any time.
Increased Transparency: Platforms must clearly inform you (upon each login, unless waived) about what data they collect, how they will use it, and to whom and in which country they sell it.
Right to Sue: If a platform violates these rules, you can bring a private civil action and seek damages of at least $5,000 or actual damages, plus legal costs.
