Justice for All Act: Stronger Anti-Discrimination Protections
This act aims to make it easier for citizens to pursue legal action in cases of discrimination. It strengthens protections against discrimination based on race, sex, age, national origin, disability, sexual orientation, and gender identity, and introduces new rules regarding housing discrimination and law enforcement practices. This means more individuals will be able to effectively fight for equal treatment and seek remedies.
Key points
Facilitates lawsuits for discrimination that is not intentional but has negative effects on specific groups (known as "disparate impact").
Expands the definition of sex discrimination to include sexual orientation, gender identity, and sex-related characteristics, including natural hair and protective hairstyles.
Prohibits pre-dispute arbitration agreements that force employees and consumers to resolve disputes outside of court, restoring the right to sue in court.
Strengthens employer liability for discrimination and makes it harder for them to defend against harassment claims.
Introduces a ban on profiling by law enforcement based on race, sex, religion, sexual orientation, or gender identity.
Allows victims to recover damages, including punitive damages (except against government entities), and legal fees in discrimination cases.
