Immigration Changes: Parent Sponsorship Limits and New Family Rules

This act modifies family-based immigration rules in the U.S., restricting the ability of adult U.S. citizens to sponsor their parents for permanent residency. It introduces a new visa category for parents, but without work authorization or public benefits. The act also alters age-out provisions for children in the immigration process.
Key points
Parents of U.S. citizens will no longer qualify as "immediate relatives" for permanent residency.
A new "W" nonimmigrant visa is created for parents of U.S. citizens (aged 21+), allowing 5-year stays without work authorization or public benefits. The U.S. citizen child must provide health insurance.
Changes to "aging out" rules mean children may lose eligibility if they marry or turn 25 before a visa becomes available.
Many pending and new family-based visa petitions, including those for parents, siblings, and adult children, will be invalidated.
The act takes effect on October 1, 2025, with immediate invalidation of many new and pending applications.
