New US Entry Rules: Bonds and Penalties for Overstaying Visas

This new act requires most nonimmigrant visitors to the U.S. to pay a bond of $5,000 to $50,000. This bond will be automatically forfeited if the individual fails to depart on time. Additionally, those who overstay will face deportation and be ineligible for legal immigration status for several years.
Key points
Most nonimmigrant visitors to the U.S. will be required to pay a bond or cash payment between $5,000 and $50,000.
The bond will be automatically forfeited without appeal if the individual does not leave the U.S. by their authorized departure date.
Individuals who overstay and forfeit their bond will be promptly removed from the U.S. and barred from obtaining any lawful immigration status for 4 to 12 years.
Asylum or withholding of removal applications must be submitted before the authorized stay expires, or the individual becomes ineligible to apply.
