Ban on Organ Transplants from China: New Health Insurance Rules

New regulations prohibit Medicare, Medicaid, and private health plans from covering organ transplants from China. Citizens considering an organ transplant must be aware that costs associated with such procedures, including post-transplant care, will not be reimbursed if the organ originates from China or was not procured according to U.S. standards.

Effective January 1, 2026, Medicare and Medicaid will not cover costs for organ transplants from China or related services (e.g., tests, drugs), unless it's to save a life after an already performed prohibited transplant.
Private health insurance plans will also be prohibited from covering such transplants or related services starting January 1, 2026.
Healthcare providers who knowingly perform a prohibited organ transplant or related services may face fines, up to 2 years imprisonment, or both, as well as significant civil penalties.
