Easier Phone Location in Emergencies: Kelsey Smith Act
This new act makes it easier for emergency services to quickly obtain phone location data in situations involving risk of death or serious harm. This aims to help respond faster to emergency calls and locate individuals in danger. Telecommunication service providers will be required to provide this data without delay.
Key points
Emergency services (police, fire, ambulance) can more quickly obtain phone location in situations of life-threatening danger or serious physical harm.
Telecommunication service providers are required to immediately provide location data upon request from authorized agencies.
The act protects service providers from lawsuits for providing location data in accordance with its provisions.
The requirement applies to both 911 emergency calls and situations where there is reasonable suspicion of a life-threatening or serious harm emergency.
