Access to Birth Control Act: Pharmacies Must Ensure Timely Provision
This new act aims to ensure that pharmacies in the U.S. must provide approved contraception without delay. Citizens will be assured of receiving necessary medications, even if a pharmacy doesn't have them in stock – in which case, ordering or referral to another pharmacy will be offered. The act seeks to eliminate barriers to contraception access, including refusals to dispense.
Key points
Pharmacies must immediately provide in-stock contraception and related medications.
If out of stock, pharmacies must offer to order the medication or refer the customer to another pharmacy that has it.
Pharmacy employees are prohibited from intimidating, misleading, or refusing to return valid prescriptions for contraception.
The act imposes civil penalties for violations and allows individuals to file lawsuits for damages.
The law does not require pharmacies that do not ordinarily stock contraception to do so, nor does it prohibit refusal for lack of a valid prescription, inability to pay, or professional clinical judgment.
