Expanding Data Sharing to Combat Counterfeit Goods in Trade.

This bill strengthens the ability of U.S. Customs and Border Protection (CBP) to share information regarding suspected intellectual property violations (counterfeits) with rights holders. CBP can now share nonpublic data obtained from online marketplaces, freight forwarders, and shipping companies with brand owners and other interested parties. This aims to improve enforcement and better protect consumers from illegal and potentially unsafe counterfeit products entering the U.S. market.
Key points
Customs can share nonpublic data about suspicious merchandise, sourced directly from online platforms and shipping companies, with brand owners.
The scope of items subject to scrutiny for counterfeiting is expanded to include packing materials and shipping containers.
The standard for initiating information sharing is clarified to "reasonable suspicion," streamlining the process of fighting illegal trade.
