Restoring Social Security Benefits Access After Administrative Hardship
This bill aims to restore access to Social Security benefits (Title II and XVI) for individuals who failed to apply between 2025 and 2029 due to "undue hardship," such as system failures, staffing shortages, or misinformation. If the hardship prevented you from applying, you will be deemed to have applied retroactively, potentially resulting in receiving back payments. Importantly, these retroactive payments will not count against your eligibility for other federal or state assistance programs.
Key points
Individuals who missed out on Social Security or disability benefits due to administrative failures or confusion between 2025 and 2029 can now apply for retroactive entitlement.
"Undue hardship" includes website outages, long phone wait times, being falsely declared dead, or confusion caused by conflicting information.
The law requires the Social Security Administration to identify affected individuals and establish a formal notification program starting in 2029.
Retroactive payments received under this Act will not affect eligibility for other federal, state, or local aid programs.
