Platform Liability for Deepfakes and Cyberstalking: 48-Hour Removal Mandate
This Act strengthens citizen protection against non-consensual sharing of intimate images, AI-generated fake content (deepfakes), and cyberstalking. Online platforms will lose their legal immunity if they fail to implement effective systems to prevent and address these violations. Crucially, platforms are now required to remove reported harmful material within a maximum of 48 hours after receiving a valid request.
Key points
Online platforms (e.g., social media) must implement systems to prevent and remove deepfakes and cyberstalking content to maintain their legal liability shield.
If non-consensual intimate content or deepfakes are reported, the platform must remove them within a maximum of 48 hours.
The definition of responsibility for creating harmful content is expanded to include materials generated using artificial intelligence models.
Platforms must preserve data necessary for potential legal proceedings initiated by victims of cyberstalking or intimate privacy violations.
