Immediate Disability Benefits for Terminally Ill; Bans Dual Benefits

This bill allows individuals with incurable terminal illnesses listed on the Compassionate Allowance list to receive Social Security Disability Insurance (SSDI) immediately, bypassing the standard waiting period. It prohibits the simultaneous collection of SSDI and unemployment benefits. It also introduces new flexibility for the Commissioner when recovering benefit overpayments, protecting recipients from a complete cutoff.
Key points
Terminally ill individuals (life expectancy under 5 years) can elect to receive SSDI benefits immediately, waiving the standard waiting period.
Choosing immediate access results in the monthly disability benefit amount being equal to 93% of the standard amount.
Prohibition on receiving both federal disability benefits and unemployment compensation in the same month; receiving unemployment compensation reduces the disability benefit to zero.
The Commissioner may decrease an overpayment withholding to an amount not less than 10% of the payment if a 100% decrease would defeat the purpose of the title.
