Fair Prices for Local Businesses Act: Strengthening the Prohibition on Price Discrimination

The Act aims to strengthen the prohibition on price discrimination under the Clayton Act. The amendments expand the provisions to include services and modify the rules of liability for inducing or receiving the benefit of discrimination.
Key points
Expands anti-discrimination rules to cover services, not just products.
Removes the provision allowing a seller to rebut a prima-facie case by showing that a lower price was made in good faith to meet a competitor's price.
Establishes that for persons with annual retail sales not exceeding $100 billion, liability for inducing or receiving the benefit of discrimination applies only if done knowingly.
Creates a conclusive presumption that a plaintiff who proves unlawful discrimination has sustained damages equal to the monetary amount of the discrimination.
